FINDINGS IN THE MATTER OF A CONTRIBUTION MADE BY
THE WILLY NEGAARD FOR SENATE COMMITTEE
TO A CANDIDATE SEEKING FEDERAL OFFICE
Procedural Background
The Willy Negaard for Senate Committee ("Committee") filed a termination Report of Receipts and Expenditures for calendar year 1998 with the Campaign Finance and Public Disclosure Board ("Board") on February 2, 1999. Review of the report by staff disclosed that on June 18, 1998, the Committee made a $200.47 contribution to the Gutknecht for U. S. Congress Committee, the committee of a candidate seeking election to office in the United States Congress.
Staff notified Herb Lovett, treasurer for the Committee, of a potential violation of Minn. Stat. 10A.27, subd. 9(b), which prohibits a principal campaign committee from making a contribution to a candidate seeking nomination or election to the United States Congress. A copy of the notification was sent to William Negaard, the candidate.
Mr. Negaard responded by letter on February 9, 1999, in which he explained that he did not know about the contribution being a problem. He closed out his committee and thought that would be the end of it.
The matter was considered by the Board in executive sessions on February 26, 1999. No one from the Committee asked to appear before the Board.
Based on the record before it, the Board issues the following:
STATEMENT OF THE EVIDENCE
1. The Willy Negaard for Senate Committee was a principal campaign committee registered with the Campaign Finance and Public Disclosure Board.
2. The Willy Negaard for Senate Committee made a $200.47 contribution on June 18, 1998, to the Gutknecht for U. S. Congress Committee, the committee of a candidate seeking election to office in the United States Congress.
3. The Willy Negaard for Senate Committee terminated its registration with the Campaign Finance and Public Disclosure Board effective December 31, 1998.
4. Minn. Stat. 10A.27, subd. 9(b), prohibits principal campaign committees from making contributions to candidates seeking nomination or election to the United Stated Congress.
Based on the above Statement of the Evidence, the Board makes the following:
FINDINGS CONCERNING PROBABLE CAUSE
1. There is probable cause to believe that the Willy Negaard for Senate Committee violated Minn. Stat. 10A.27, subd. 9(b), when it made a $200.47 contribution on June 18, 1998, to the Gutknecht for U. S. Congress Committee.
2. Minnesota Statutes, chapter 10A provides no penalty for this violation.
Based on the above Findings, the Board issues the following:
ORDER
The Board investigation of this matter is entered into the public record in accordance with Minn. Stat. 10A.02, subd. 11.
Board staff shall provide a copy to William Negaard.

THE (TOM) VAN ENGEN VOLUNTEER COMMITTEE
TO A CANDIDATE SEEKING FEDERAL OFFICE
Procedural Background
The (Tom) Van Engen Volunteer Committee ("Committee") filed a termination Report of Receipts and Expenditures for calendar year 1998 with the Campaign Finance and Public Disclosure Board ("Board") on February 1, 1999. Review of the report by staff disclosed that on October 8, 1998, the Committee made a $500 contribution to the Craig Duehring for Congress Committee, the committee of a candidate seeking election to office in the United States Congress.
Staff notified Tom Van Engen, candidate, of a potential violation of Minn. Stat. 10A.27, subd. 9(b), which prohibits a principal campaign committee from making a contribution to a candidate seeking nomination or election to the United States Congress.
Mr. Van Engen responded by letter on February 16, 1999, in which he explained that he did not know the contribution was prohibited at the time it was made.
The matter was considered by the Board in executive sessions on February 26, 1999. No one from the Committee asked to appear before the Board.
Based on the record before it, the Board issues the following:

Based on the above Statement of the Evidence, the Board makes the following:
