Statutory authority for local reports posting
If a local government has a website, Minnesota statutes section 211A.02, subdivision 6, requires the government's filing officer to post local campaign finance reports on the website. Reports must be posted as soon as possible and no later than 30 days after receipt by the filing officer. The reports must remain available on the local government's website for four years from the date the report was initially posted. The statute also requires the local filing officer to provide the Campaign Finance and Public Disclosure Board with a link to the webpage where the reports are posted. The Board publishes those links on its local campaign finance reports page.
The types of local governments and filing officers who must follow the statute are:
- Counties
Filing officer: County Auditor
- Cities
Filing officer: City Clerk or Administrator
- Townships
Filing officer: Town Clerk
- School districts
Filing officer: School Board Clerk
If your local reports link isn't listed on the Board's website
- If you don't see your local jurisdiction listed:
- Consider whether your government maintains its own website. If it doesn't, the requirement to post campaign finance reports does not apply.
- Consider the number of registered voters in the local jurisdiction. If the local jurisdiction is a city or town and has fewer than 400 registered voters as of January 1 of an election year, the requirement to post campaign finance reports does not apply.
- Contact your local filing officer and ask if any campaign finance reports have been filed in the past four years. In some cases there may be no candidates or committees required to file reports with a local filing officer covering a given year under Minnesota statutes section 211A.02, in which case there will be no reports to be posted.
- If the local jurisdiction has a website and has received campaign finance reports, the reports are required to be posted on the website and the filing officer is required to provide the Board with a link to the webpage.
