OPINION Yes, an individual who seeks nomination or election to an office without appearing on the ballot may be a "candidate" for purposes of determining first time candidate eligibility. Minn. Stat. § 10A.01 subd. 10, defines "candidate" for the purposes of Chapter 10A. It defines a candidate as an individual who one third of the population of the Senate seat you now seek, you do not qualify as a first time candidate and are not eligible to receive a 10% increase in your expenditure limit under the provisions
